APPLICABLE TO ALL BOOKINGS

AGREEMENT

When you make your booking, we will facilitate the establishment of a contract between you and each of the third-party suppliers of your travel arrangements, which may include but are not limited to tour operators, airlines, cruise operators, accommodation providers, car hire services, and transfer companies, as specified in your booking confirmation. This contractual relationship comes into effect upon the issuance of your booking confirmation by us.

Your engagement with us is governed not only by these Booking Conditions but also by the specific terms and conditions imposed by the third-party suppliers. These additional terms govern the services they render and to which you will be irrevocably bound. In instances where there exists a conflict between a supplier’s terms and these Booking Conditions, the supplier’s terms shall take precedence, except where such terms are determined by English law to be invalid or unenforceable. In such cases, the relevant provisions of our Booking Conditions will prevail. It is important to note that some of our suppliers’ conditions may limit or exclude their liability to you, which may consequently limit or exclude our liability as well. Furthermore, many suppliers’ terms may also be subject to international conventions that impose restrictions on liability, affecting both their obligations and ours. Copies of the applicable suppliers’ terms and conditions, as well as any relevant international conventions, can be provided upon request.

In our capacity as an agent, we disclaim any responsibility for the acts or omissions of the suppliers or for the travel services they provide, except where we are the organiser of your package holiday under the Package Travel Regulations. In such cases, we will accept responsibility for those travel services in accordance with Section B of these Booking Conditions.

Your contract with us is governed by English law, and any disputes arising will be subject to the jurisdiction of the English courts. However, should you reside in Scotland or Northern Ireland, you have the option to select the law and jurisdiction of your respective region.

All bookings are categorically non-refundable, non-changeable, non-transferable, and subject to 100% cancellation fees, unless explicitly stated otherwise at the time of confirming your booking

Bookings Made by Telephone: Should you elect to make a booking via telephone, it is incumbent upon you to furnish us with all requisite information as dictated by our protocols. You must ensure the accuracy of all information provided, particularly that passenger details are aligned precisely with those appearing on the respective passports. Furthermore, you must ascertain that the credit or debit card utilized for the transaction is registered in your name. In instances where a third-party card is employed, you are required to secure their unequivocal authorization to use their card, and confirm the availability of sufficient funds to cover the total cost of the arrangements booked through our services.

It is critical to understand that a booking confirmed via telephone holds the same binding validity as one finalized in writing. We do not extend any guarantees regarding the availability of any package holiday, flight, or individual components until such time as payment is received and confirmation is duly issued. Upon the acceptance of your booking, we will initiate the processing of the same, contingent upon availability, and will proceed to debit the requisite payment from your account. From this juncture forward, cancellation charges will become applicable.

You will subsequently receive a confirmation, along with an e-ticket and an invoice. Upon receipt of these documents, it is essential that you conduct a thorough review of the details contained therein and promptly notify us of any discrepancies, as amendments may not be feasible post-confirmation. Please be advised that any alterations to the booking after it has been finalized will incur supplementary costs, which will be the responsibility of the customer. This includes, but is not limited to, charges imposed by suppliers as well as any applicable administrative fees.

BOOKING CONFIRMATION / TRAVEL DOCUMENTATION

Important: It is imperative that you meticulously review your confirmation, e-ticket, and all other documentation related to your booking, as it is your responsibility to verify the accuracy of the information contained in your confirmation invoice. Should you identify any discrepancies, you must notify us immediately. Please be aware that the pricing of your travel arrangements may have increased since the initial booking, and we regret that we cannot accept any liability for inaccuracies unless we are promptly informed. While we will make every effort to assist in rectifying any errors, you will bear any associated costs as detailed in clause 26 of these terms.

We rely on the accuracy of the information you provide; therefore, we cannot be held accountable if your e-tickets do not arrive due to an incorrect email address. It is your responsibility to inform us immediately of any changes to your address, telephone number, or email address. We strongly recommend providing a mobile telephone number at the time of booking, as this will facilitate our ability to contact you regarding any changes or cancellations of which we become aware.

You should ensure that you retain a copy of your travel documentation, including your booking confirmation, e-tickets, and any other necessary travel documents (such as your passport and relevant visas, if applicable), at all times. We shall not be liable for any failure on the part of a supplier to provide the booked product or service if you do not present the appropriate documentation.

PASSPORTS, VISA, AND HEALTH REQUIREMENTS

You bear the responsibility for verifying all passport, visa, and health prerequisites and ensuring that your travel documentation is in proper order.

Passport and Visa: It is essential that you consult the relevant Embassy or Consulate to obtain this information. Requirements are subject to change; thus, it is advisable to verify the most current regulations well in advance of both booking and departure.

We disclaim any liability should you be denied boarding on the flight or entry into any country due to your failure to present the requisite passport, visa, or other documentation mandated by any airline, governmental authority, or country. You must possess a passport that remains valid for at least six months beyond your intended return date. Additionally, you must ensure compliance with the correct visa and health entry requirements for all countries you will visit, including any nations through which you may be transiting. This encompasses all stops made by the aircraft, regardless of whether you disembark from the aircraft or remain within the airport. If your passport is nearing its expiry date, particularly within its final year, it is prudent to consult the Embassy of the country you intend to visit. For more comprehensive information, contact the Passport Office.

Special stipulations apply to travel to the United States—each passenger is required to possess an individual machine-readable passport, and travellers must apply for an Electronic System for Travel Authorization (ESTA) no later than 72 hours prior to departure for the United States. Arriving at the airport without an approved ESTA may result in denial of boarding. For further updates regarding travel to the USA, please refer to uk.usembassy.gov Regarding European travel, your European Health Insurance Card (EHIC) remains valid only until its expiration date, and it is imperative that you procure comprehensive medical insurance prior to departure. Additionally, parents traveling with children under the age of 18 to South Africa will be required to present the child’s full unabridged birth certificate.

An Electronic Travel Authorization (eTA) is an entry requirement for visa-exempt foreign nationals travelling to Canada by air. Electronic travel authorization (eTA) to fly to, or transit through, a Canadian airport.

PRICES & PAYMENTS

Payment for Travel Services is either processed by us or affiliates part of our corporate group (in cooperation with our payment service provider(s) who supply the payment processing functionality), or by the Service Provider. All payment information belonging to our customers is encrypted in a secure server when shared with our payment service provider(s).

We retain the discretionary right to amend the prices of any holiday packages displayed on our website. You will be informed of the prevailing price for the holiday of your choice at the time of booking, and this price will be confirmed prior to the finalization of your contractual agreement.

When initiating a booking, you will be required to submit a per-person deposit. The precise deposit amount will be communicated at the point of booking. In certain instances, full payment may be mandated upfront, in which case you will be duly notified. The remaining balance must be settled no later than 12 weeks prior to your scheduled departure, except where the deadline of the package may differ as per our suppliers and consolidators in which event our service team will inform you of the revised due date. Failure to remit the deposit and/or balance within the specified time frame will entitle us to cancel your booking, and, where the balance remains unpaid, we will retain any deposit received.

Payments may be transacted via credit or debit card through our payment link provided, by contacting our office at 9711992359 or by transferring to our Bank Account. Additionally, we reserve the right, at our absolute discretion, to refund your deposit or any other payments made and to withhold issuance of a booking confirmation.

Please note: any refunds that may be due to you will be returned via the original payment method, and, if paid by credit or debit card, funds will be refunded directly to the card used at the time of booking and may take 6-8 weeks. This may be delayed if we have not received the money from the airlines, hotels or our suppliers.

We reserve the right to adjust the prices of confirmed holiday packages exclusively to account for increases that arise directly due to changes in:

(a) The cost of passenger transportation resulting from fluctuations in fuel prices or other energy sources;

(b) taxes or fees imposed by third parties not directly involved in delivering the holiday services, including, but not limited to, tourist taxes, landing fees, or embarkation/disembarkation fees at ports and airports; and

.

(c) exchange rates applicable to the package.

These price adjustments may include, but are not limited to, alterations in airline costs, which form part of our contractual agreements with airlines (and their representatives), cruise ship operators, and other transport providers.

Any such increases will be charged to you in accordance with the provisions of this clause. However, should these adjustments result in a price increase exceeding 8% of the total cost of your confirmed package holiday (excluding any insurance premiums, amendment fees, and/or costs for additional services or travel arrangements), you will have the option to either:

  • Accept a substitute holiday package, should we be in a position to offer one. If the substitute is of equivalent or superior quality, there will be no additional charge; if it is of lower quality, you will receive a refund of the price difference.
  • Cancel your booking entirely and receive a full refund of all monies paid to us, excluding any insurance premiums, amendment fees, and/or costs associated with additional services or travel arrangements.

If you opt to cancel under these circumstances, you must exercise this right within 7 days of the issue date on your final invoice. Should you be able to demonstrate that you are unable to transfer or reuse your travel insurance policy, we may consider an appropriate refund of any insurance premiums paid.

Please be advised that our prices are set based on bookings made by UK residents. Non-UK residents or those without a UK passport may incur additional charges directly from the supplier upon check-in or check-out. Such charges fall outside our responsibility, and we shall bear no liability for these additional costs.

Payment fraud:

If there are reasons for us to suspect that fraud is being committed, We reserve the right to refuse processing of such payment. Legitimization of Payment may be demanded if a crime is suspected. All types of payment fraud will be reported to the police.

INSURANCE

It is a stipulation of our contractual agreement that you maintain adequate travel insurance to cover the entirety of your travel arrangements. At a minimum, such insurance must provide comprehensive coverage for potential losses incurred due to cancellation, medical contingencies, and repatriation in the event of accident or illness. Should you elect to proceed without sufficient insurance coverage, we disclaim any liability for losses of any nature that may arise in circumstances where appropriate insurance coverage would otherwise have applied.

UNEXPECTED EVENTS

Except as otherwise expressly specified within these Booking Conditions, we disclaim any liability or obligation to compensate where our contractual duties to you are impacted by Events unpredictable. For the purposes of these Booking Conditions, "Unexpected events" encompasses any event or circumstance beyond the control of ourselves or our suppliers, where the consequences could not have been mitigated through the exercise of all reasonable measures. Such events may include, but are not limited to, warfare, acts of terrorism (and threats thereof), civil unrest, epidemics, pandemics, or other significant health risks, including serious disease outbreaks at the travel destination (inclusive of ongoing COVID-19 impacts); natural disasters such as floods, earthquakes, or severe weather conditions rendering travel to or within the destination unsafe; actions taken by government or national/local authorities, including port or river authorities; industrial disputes, strikes, lockouts, port closures; and natural or nuclear disasters, fire, chemical or biological incidents, unavoidable transport-related technical issues, among other analogous events outside the control of ourselves or the relevant suppliers. In the event that your early return is necessitated by unforeseen circumstances, we will liaise with the hotels and our suppliers to seek a refund for the unused balance of your accommodation.

EFFECTS OF BREXIT

Please be advised that certain travel services may be subject to modification as a result of the United Kingdom's departure from the European Union. Potential ramifications may include adjustments to flight route availability or limitations on access to specific ports and airports. We are committed to closely monitoring these developments and will promptly notify affected customers of any confirmed booking adjustments. Nonetheless, given the unprecedented nature and externality of these issues, we will classify any such changes as Events Beyond Our Control. While we shall endeavour to offer alternative arrangements or issue refunds where practicable, we disclaim liability for compensation in these instances.

SPECIAL REQUESTS

Special requests concerning your travel arrangements must be communicated to us at the point of booking. While we shall make every reasonable effort to accommodate such requests, we cannot guarantee their fulfilment. Should we be in a position to specifically confirm any special request or requirement, this will be explicitly documented on your booking confirmation. In the absence of such written confirmation, any failure to satisfy the requested arrangement shall not constitute a breach of contract on our part, nor will it impose any liability upon us to provide compensation.

Please note that accommodation providers cannot guarantee interconnecting rooms, even when requested, and airlines cannot guarantee the seats you have selected. If you paid extra for a seat that was not provided, we will liaise with the airline to arrange a refund for this cost.

If, acting reasonably, we are unable to accommodate your specific needs, we reserve the right to decline your booking; however, every effort will be made to assist you wherever possible. If you did not provide full details of your requirements at the time of booking and we later become aware of them, we reserve the right to cancel your booking and apply the applicable cancellation charges.

AMENDMENTS & CANCELLATIONS BY YOU

Should any amendments be required before or during your travel, please ensure that your request is submitted in writing via email, by phone, or through WhatsApp. Upon receipt of your request, we will make every reasonable effort to accommodate your request; however, please note that this cannot be guaranteed, as it is subject to the applicable booking conditions. If adjustments are possible, any relevant charges imposed by airlines, hotels, or suppliers will apply, along with our administrative fee of £100 per person.

Regarding cancellations, please be advised that all bookings are non-refundable, non-changeable, and non-transferable, and therefore subject to a 100% cancellation fee. You may cancel your booking at any time by submitting a request in writing via email, phone, or WhatsApp, including the necessary booking reference.

For requests initiated via phone or WhatsApp, we will initiate the process; however, final processing will only occur upon receiving written confirmation from the registered email address on file. Please note that once paid and booked, all reservations are strictly non-refundable.

DISABILITIES AND MEDICAL PROBLEMS

Should you have any specific requests, we kindly urge you to communicate them to us at the point of booking. While we shall endeavour to relay such requests to the applicable supplier, we regretfully advise that we are unable to assure their fulfilment. The mere notation of a special request on your confirmation invoice or any other documentation, or its transmittal to the supplier, does not constitute confirmation of its fulfilment. Any inability to meet a special request shall not constitute a breach of our contractual obligations, and bookings contingent upon the satisfaction of any special requests will not be accepted.

In the event that you have a medical condition or disability which may impact your travel arrangements, you are required to provide full written disclosure prior to booking. It is important to note that numerous international destinations may lack even the basic facilities necessary to support disabled travellers. As a condition of booking, we may require a medical certificate from a qualified doctor attesting to your fitness to travel. Acting within reasonable bounds, if we are unable to adequately accommodate the needs of the passengers/guests involved, we reserve the right not to confirm your booking. Furthermore, if full disclosure was not provided at the time of booking, we retain the right to cancel the booking and apply the relevant cancellation charges upon receiving such details.

COMPLAINTS

Should you encounter any difficulties or issues of non-conformity during your holiday, it is essential that you notify us without undue delay, enabling us to take reasonable measures to assist you or rectify the situation. Failure to inform us in a timely manner may preclude us from considering any claims for refund or compensation. For immediate assistance, you may reach us via email at [email protected] or by telephone at 9711992359.

In the event that your complaint remains unresolved and you wish to pursue the matter further, please submit a formal written notice of your complaint to [email protected] within 28 days following the conclusion of your travel arrangements. Your notice should include your booking reference and all relevant details. Please be advised that failure to adhere to the procedure outlined in this clause may hinder both our ability and that of the relevant supplier to thoroughly investigate your complaint, and may ultimately impact your entitlements under our contractual agreement.

DELAYS

We disclaim liability for any delays attributable to unavoidable and extraordinary circumstances. It is important to understand that a delay or cancellation of your transportation service does not inherently confer the right to cancel any other related arrangements, notwithstanding that such arrangements may have been coordinated with your transport booking. Nevertheless, you may retain the right to pursue a claim under the delay provisions of your travel insurance policy.

ALTERATIONS TO BOOKING CONDITIONS AND DISCRETION TO REJECT TRAVEL PLANS

We reserve the right, at our sole discretion, to amend, withdraw, or add to any of our Booking Conditions at any time and without prior notice. Additionally, we reserve the right to decline any booking request at our discretion.

EU COMMUNITY

In compliance with Regulation (EC) No 2111/2005, Article 9, we are obligated to inform you of the existence of a “Community List” that enumerates air carriers subject to an operating ban within the European Union. This Community List can be accessed for review at the following link: https://ec.europa.eu/transport/modes/air/safety/air-ban_en.

CREDIT CARDS

It is essential that you or a member of your party carry a recognized credit card while traveling, as your Travel Service Provider may require a deposit. This deposit could be requested at various times, including hotel check-in or car hire collection, and the amount will vary depending on the provider.

Your Travel Service Provider may need to process an authorization request with your credit card provider and/or place a hold on the credit card to cover any potential charges incurred during your stay, such as room service, mini bar items, and fuel shortfalls. Please ensure that your credit card provider is informed before you travel abroad, and that the credit card you intend to use has an adequate credit limit.

Additionally, be aware that your credit card provider may charge fees for cross-border or international transactions and may apply foreign currency conversion fees. We recommend checking with your credit card provider for detailed information about any fees that may apply.

TRAVEL ADVISORY

DATA PROTECTION AND PRIVACY

As a prerequisite for processing your booking, we require the provision of various personal details, which may include, but are not limited to, your name, email address, telephone number, passport number, and other identifying information. In addition to these standard identifiers, we may also collect sensitive category information as voluntarily disclosed by you, encompassing health and medical history, details pertaining to any disabilities, and religious beliefs.

The processing of your personal information, inclusive of any sensitive category data, will be undertaken solely for the purpose of executing your booking. Such information may be disclosed to relevant suppliers involved in your travel arrangements, as well as to any other parties integral to the provision of your travel services, as deemed necessary for the effective coordination of your travel plans. Furthermore, in compliance with applicable legal requirements or upon request from relevant authorities, your data may be communicated to public authorities, including but not limited to customs and immigration agencies. Additionally, certain information may be transmitted to security or credit verification entities.

Should you be traveling to the United States, it is imperative to note that we are obligated to convey your personal information to the U.S. Customs and Border Protection, which is mandated by law to prevent and combat terrorism and other serious transnational crimes. In instances where your travel involves destinations beyond the European Economic Area (EEA), we will transfer your data to suppliers situated outside the EEA, ensuring compliance with the provisions set forth in the General Data Protection Regulation regarding such international transfers.

By affirming your booking, you explicitly acknowledge and consent to the potential sharing of your personal information, as outlined herein, with suppliers and any relevant third parties necessary for the facilitation of your travel arrangements.

INDEMNIFICATION

You agree and must at all times indemnify, defend and hold Talk Marketing and Technologies Ltd and its third party suppliers or licensors, each of Talk Marketing and Technologies Ltd and their business partners and each of Talk Marketing and Technologies Ltd and their respective employees, officers, directors, managers and representatives (each an “Indemnitee” and collectively the “Indemnitees”), harmless from and against any and all losses, damages, liabilities, judgments, penalties, fines, costs and expenses (including attorneys’ fees and court costs) suffered or incurred by any of the Indemnitees as a result of any third party claim, action, suit, or proceeding arising out of or incident to (i) Your use of or access to the Portal in a manner not authorized by these T&Cs or in violation of any applicable laws, (ii) any breach by you of any term or condition of these T&Cs, including without limitation, any representation and warranty hereunder. We will promptly notify you of any claim which We become aware of and which We believe to be subject to indemnification under this Section.

BEHAVIOUR

You bear the responsibility to ensure that you and all members of your party refrain from behaviour that may cause offense, distress, or present a risk of harm or damage to property belonging to others. Should any such loss or damage occur, immediate payment is required directly to the accommodation owner, manager, or applicable supplier. Furthermore, you agree to indemnify us against any subsequent claims, including legal expenses, arising from your actions.

We expect all clients to demonstrate consideration towards others. Should we, or any other person in authority, reasonably determine that your behaviour is causing or is likely to cause distress, danger, or substantial annoyance to third parties, or damage to property, we reserve the right to terminate your travel arrangements without prior notice. In such instances, all aspects of your booking, including return travel arrangements, will immediately cease, and we accept no responsibility for covering any associated costs, expenses, refunds, or compensation.

Failure to make immediate payment for damages may result in you being held liable for any subsequent claims, including legal costs, brought against us due to your conduct, as well as any expenses we incur in pursuing a claim against you.

Additionally, we cannot be held liable for the actions or behaviour of other guests or individuals unassociated with your booking or with our services.

OUR RESPONSIBILITY

Liability as Organizer:

  • You accept that We act as an intermediary between You and the Service Provider. We will under no circumstances be held liable with respect to Travel Services You have booked with one or more Service Providers.
  • Should a Service Provider be unable to provide the Travel Service for any reason, including where a Service Provider declares for bankruptcy, We can only act as an intermediary and refund payments where we have already received such from the applicable Service Provider.
  • Claims relating to performance of Travel Services: Any problem, remark or claim relating to actual performance of the Travel Services must be addressed directly to the relevant Service Provider (travel operator, airline, insurer, car rental company, hotel) with whom you hold the contract for the relevant Travel Service.

When providing payment, we reserve the right to deduct any sum already received by you or to which you are entitled from the transport provider or hotelier in relation to the claim in question.

For liability to be accepted under this clause, it is essential that any claim is submitted to us and the Supplier/Principal(s) in strict accordance with our established complaints procedure.

Where any payment is made, the recipient(s) (including a parent or guardian if the recipient is under 18) must assign to us or our insurers any rights to pursue relevant third parties and agree to provide any reasonable assistance requested by us or our insurers.

Please note, we disclaim liability for any damage, loss, expense, or other claims:

a) That, based on the information you provided at the time of booking, could not reasonably have been anticipated; or b) That pertain to business purposes.

Exclusions for Unlisted Services: We cannot accept responsibility for services or facilities that do not form part of our agreement, nor those which are not advertised in our official materials, such as any excursion booked while away or any arrangement made directly with your hotel or other suppliers.

CANCELLATION OR AMENDMENT BY US

If the supplier enacts an adjustment deemed minor within the scope of your travel arrangements, we will endeavour to apprise you at the earliest possible moment, contingent upon sufficient time before departure; however, such minor changes entail no liability on our part. Minor changes may include, but are not restricted to:

  • Reallocation of accommodations to a property of equivalent or superior standard
  • Alterations in carriers or slight modifications to available hotel services
  • Modification of your outbound or return flights by less than 24 hours
  • Substitution of aircraft type

In contrast, the supplier may, on rare occasions, necessitate significant alterations to your confirmed travel itinerary. Instances constituting “significant changes” include:

  • Major itinerary amendments, such as the omission of one or more destinations
  • Downgrade of accommodations to a lower standard or classification for the entirety or a significant portion of your stay
  • Shifts in outbound departure time or overall travel duration by more than 12 hours
  • Change in UK departure airport, barring switches between designated London airports
  • Relocation of your accommodations to a different area for the entirety or a substantial portion of your stay

Should the supplier/principal effectuate a significant change or cancellation to your travel plans, we shall inform you promptly and, providing there is adequate lead time before departure, present you with the following options:

  • Acceptance of the revised travel arrangements
  • Full reimbursement of all payments made
  • An alternative travel option of comparable or superior standard at no additional cost, if available
  • An alternative travel option of a lower standard, if available, accompanied by a refund reflecting the price differential between the original and revised arrangements

Please be aware that independent travel arrangements, including flights, airport parking, car hire, or other services you may book separately, do not constitute any part of our contract with you or that of the supplier/principal. Consequently, if adjustments to your travel arrangements become necessary, neither we nor the supplier/principal will be liable for any additional costs, amendment fees, or cancellation charges you may incur for such independently arranged services.

JURISDICTION AND APPLICABLE LAW

This contract, along with any matters arising from it, shall be governed by and construed in accordance with English law. Both parties agree that any dispute, claim, or other issue arising out of or in connection with this contract or your holiday will be exclusively resolved by the courts of England and Wales.

NO SHOW

If you have made a confirmed booking for any travel service—such as flights, car hire, accommodation, or packages—but fail to utilize it (for example, by not checking in for your flight or accommodation, or not collecting your rental vehicle), a refund may not be available. Additionally, cancellation charges of up to 100% may be applied by the relevant supplier. However, for flights, it may still be possible to obtain a refund of the departure tax paid for the flight.

ACCOMMODATION RATINGS & SERVICES

All ratings are either provided by the relevant supplier or represent our own average ratings, based on our industry knowledge and customer feedback. Ratings provided by us are clearly marked and are intended to serve as a guide to the quality of services and facilities you can expect from your accommodation. Please note that standards and ratings may vary between countries and suppliers, and we cannot guarantee the accuracy of any ratings displayed.

We have made reasonable efforts to verify the official rating of each accommodation and include it in the descriptions provided on our website.

It is important to understand that the standards and health and safety regulations applicable to your travel arrangements will be those of the country where the services are provided, not those of the United Kingdom. These standards may differ from, and in some cases be lower than, those in the United Kingdom.

Please note that each hotel or resort offers unique products and services. We strongly recommend that you carefully review the details of the hotel or resort’s offerings before finalizing your booking to avoid any inconvenience upon arrival.

We cannot be held responsible for any dissatisfaction you may experience with the room ambiance, products, or services, as these factors are beyond our control. However, we will make every effort to assist you in securing an alternative room, an upgrade, or even a change of hotel to meet your preferences. Please note that any additional costs incurred for such changes will be your responsibility.
